Employment Law Update

Broadening the Scope of the Employees (Provision of Information and Consultation) Act, 2006

As and from 23rd March 2008, all organisations that employ 50 or more employees will be subject to the Employees (Provision of Information and Consultation) Act, 2006.

Employment Rights Compliance Bill Published

The Employment Rights Compliance Bill, 2008 was published on 18th March 2008. The Bill seeks to modernise the Labour Inspectorate, strengthen enforcement of employment rights and work permits, promote greater compliance in the workplace and increase penalties for those employers who seek to gain advantage by denying employees their entitlements under law.

Graphite Consultation Queries (for Clients only)

  1. In an organisation with 3 part time staff (in excess of 3 years experience) and the rest full time, the 3 part time staff have been arbitrarily informed that they are being reassigned to duties normally conducted by junior staff. There was no consultation regarding the change of duties. Do the employees have any recourse under employment legislation?
  2. What kind of records might an Employment Law Inspector look for during a visit to my organisation?
