Workshop Content
This two-day workshop is designed for people who are designated under your organisation’s Dignity at Work policy to handle formal investigations into complaints made by an employee. It is targeted at HR professionals, managers and owners who have been selected for your organisation’s investigator panel. The workshop takes account of equality and health and safety legislation, and codes of practice. It focuses on building the skills and expertise to conduct effective investigations into complaints.
Session Outline:
The Key Principles
Outlines the key principles that must drive an investigation procedure.
Explains and outlines the rules of natural justice. Explains the process
of testing evidence before coming to a conclusion.
Defining Harassment, Sexual Harassment and Bullying
Describes what type of complaints may result in a formal investigation.
Outlines the legal obligations contained within the Employment Equality
Acts, 1998 - 2008, in relation to harassment and sexual harassment. Outlines
the legal obligations contained within the Safety, Health & Welfare
at Work Act, 2005, in relation to bullying.
The Investigation Process
Explains the requirements provided for investigations as outlined in the
Code of Practice.
Explores what must be contained in a Terms of Reference and outlines the
different phases the investigation must move through, and how to plan for
those. Reviews the process of interviewing the complainant, respondent and
witnesses.
Communication Skills
Establishes the importance of effective and non-biased questioning. Reviews
the skill for questioning, listening and note taking. Reviews the process
of putting together a written statement based on information gathered in
an interview.
Developing Investigation Skills
The session follows on from the first day of theory and practical case studies
and allows delegates to apply the skills and knowledge learned. There is
a skills practice element, which is video-taped and individual feedback
is given to each delegate.
Concluding the Investigation
Explores the report writing process, and collection of information for the
investigation file. Outlines the contents and structure of an investigation
report. Explores follow up actions and responsibilities.
This workshop is also available on an in-house basis, and the content can
be customised to take account of the organisation's own Dignity at Work
policy.
